My suggestions:
1. Combine labor certification and I-140 into a single process. It doesn't make sense to have two stages for employment based petition.
Advantages:
Candidate will know the result in a single stage. Once that stage is cleared he will know he is good to go from an employer perspective. Right now even after clearing Labor stage one is not sure what happens at I-140 stage. This leads to more uncertainty, worst case he will have to restart the GC process again if 140 stage fails after waiting for couple of years.
2. Ability to Pay requirement should be only for a few years ( 2- 3 years) from the priority date.
Right now if DOL/USCIS takes its own sweet time in processing perm/140 cases ( as happened for July fiasco cases), employer has to prove ability to Pay for all the years from the priority date. A company can close down, can go bankrupt in a recession during these long years. We have seen big wallstreet firms go belly up in this recession.
3. Pre-adjudicate all 485 cases within 18 months from the day it is filed. Once pre-adjudicated, the case should be accorded a FINAL status which means all processing requirement for the case has been met and no further RFEs can be issued on the case. Online status of the case should reflect the FINAL status.
Right now backlogged country candidates has to wait for a long time in uncertainty due to the current process. Once this change is implemented, candidates can have a peace of mind and guarantee that they will get a GC once visa number are available.

Sorry to do this to you but, to be "politically correct", the Reps in the House are addressed as Congressmen/congresswomen. Only Robert Menendez in that list is addressed as a Senator since he serves in the Senate.
Minor technicality, but, the Reps would want to be addressed the correct way.
Now now..its was slip up dude, well being new to this county and their lingo!! I did write some of earlier posts addressing them as congressman/congresswomen. Now all I wanted was the poll to be opened..no news yet!!!

she is chairwoman for subcommittee on Immigration, Citizenship, Border Security and International Law.
How much clout does this congresswoman have? She seems to understand the entire scenario better than any american soul out there! It also seems like she has spent a lot of time on this and understands the system very well.
I guess it remains to be seen what kind of impact her letter will have on USCIS. Obviously, USCIS did something unlawful.

Menendez Wants CIR During Lame Duck Session

On yesterday's "Al Punto," the Spanish-language TV network Univision's Sunday morning news program, Sen. Robert Menendez said he will introduce "comprehensive immigration reform" legislation in hopes of getting it passed during the upcoming lame duck session of Congress.
"If we are going to be ready for the opportunity that perhaps will exist during the session after the elections -- where many senators are retiring and have the freedom to vote without political considerations -- we have to have something so that we can make progress at that moment in November," the New Jersey Democrat said in an interview with host Jorge Ramos.
If the bill does not pass in November, he said, he and other supporters of the legislation will be ready to move when the new Congress convenes in January.
In a separate segment of the same program, Ramos interviewed Arizona Gov. Jan Brewer, who rejected claims that the state's controversial new immigration law, widely known as SB 1070, is racist and anti-Hispanic.
"The Hispanic population is part of our DNA, and that's why it's so painful when persons think that it is based in racism," Brewer said. (This is a translation of the program's Spanish-language voice-over of her remarks.) She called Hispanics "a fundamental part of our culture."
"We passed SB 1070 because we cant accept the costs of illegal immigration," Brewer told Ramos.

My daughter accompanied me on H4 visa. My labor was approved in June 2006 and she turned 21 in July 2006. My I 140 was approved in Dec 2006. I have received valuable inputs from IV members and understand that she has aged out. I believe that things can be simplified if unmarried children under 21 who come as dependants of workers with dual intent visas or similar catagories are exempt from ageing out rules. This may avoid lengthy rules, computations, complex interpretations and possibly lawsuits.

The situation is the same. In my case and of course in most of others too, what he/she said is correct. Waiting for Eb3 to cross 2001 has become a difficult thing. If I started an EB2 app rather than hoping positively, I would have finished my wait for GC.
Ever since retrogression started the dates have not crossed 2001. 245i or not, the backlog is a fact. Sad part, when there is action items from IV, trying to talk to my state members, I have realized and been told that IV does not cater to EB3 anymore. The whole GC system is not fair ...
1) Country quota -- People from smaller countries get it very quickly while ohter keep waiting forever ....
2) Assume I applied in 2006 NOV ...lets say my friend applied in 2005 NOV ..his/her spouse comes to US in 2009 after getting married and he/she gets GC first before me ...
3) People struck in back logs ...most unfortunate guys of all
4) People struck in FBI name checks while others who appled after them keep on getting GCs ...
List goes on ............Hope some day it will become strict FIFO across all countires and it will become predictable ...

My wife is on H4 visa with a valid I-94 (till Feb 2009) but her status will be on H1 from Oct 1st, 2007. Do we need to go for stamping before she starts working. Also who applies for SSN - Her employer and do we need to file ourselves. The employer kept the original H1. Do we need the original to apply for SSN? How soon can we apply for SSN?

You dont need to stamp your passport before you start working. Stamp is only needed to get into the US.
I think you have to go yourself and apply for SSN unless employer tells you otherwise. That's what my wife did. There are SSN offices everywhere. You can apply right away. Make sure you apply ASAP because unless you get your SSN, you cannot be paid and it takes a few days to get it. You need original documents. Has anybody received something similar? Seems canned and asking to wait for another 6 months holy cow?What is the next step Info Pass?

While IV has not lobbied for any particular EB category but I think that is what they should be doing. Isn't one of IV's goals is to end retrogression ... so shouldn't EB3 be at least lobbied for since they are in such a mess ... I don't believe it sometimes that we are still in 2001.. that is 10 years back.
In a couple of years EB2 will be more or less current. So that means a guy who came two years back will file in EB2 and get his GC and I who has been working here for 12 years would still be waiting in line.
Some people say EB1 are brighter than EB2 and EB2 are brighter than EB3 . I find that funny because no one Eb1 or EB2 or EB3 is brighter than anyone unless someone has an extraordinary PHd or is a scientist . Its the lawyers who are brighter and how co-operative your company is.
Besides when we filed in EB3 categories there was no retrogression and hence no one cared or else we also would have filed in Eb2 and got our GC.
I think time has come for IV to lobby for help to EB3 people specifically since EB2 is almost done .
I was in DC for the advocacy days, and as many of the attendees have written, there was not a single line that indicated of IV's preference for EB2. In fact, us members were told how futile the argument was - because no law is ever passed for one category alone. if you pay $90 extra, they will process it the same day. you can add $20 extra to get it overnight if you dont want to wait in the consulate. They are very friendly. I got it same day shipped out. All that you need is to pay more money (ofcourse this money goes to govt of india, not to the employees work there :) )

Don't stress out too much!!! Sleep calmly till dawn and believe me next morning will be more rewarding.
There is one thing which all of us can do and I belive it will be more effective than a rally(And certainly will cost less).
all we need to do is spread the problems we are facing whenever we buy high value goods like cars or homes. tell the dealer / broker / edu instituitions ..I would have closed the deal if I had a green card ..so the next time congress takes up this bill ..there would be more support for increased legal visas ...unfortunately many of us are selfish ,...we just run and buy houses as soon as we get EADs

Ok. We all agree that EB3 India is in bad shape and needs help.
