Hello Gurus,
I have got my wife passport stamped(H4) until Oct'09 based on my previous H1. I have changed company and got new I-797 for both of us valid till Apr'2010. During her recent visit to India and return to USA, at the port of entry she was issued I-94 till Oct'2009 eventhough her I-797 form my new employer is valid till Feb'2010.
I don't want to ask my wife to cross the broder (@Mexico or @Canada) for the sake of renewing her I-94. I am wondering if I can apply with USCIS for her extension of I-94 till April'2010 for which she has I-797 to support it.

Jason, agree with Kevin. I did take a quick look at your site however and I see you like to do landscapes. You have a good eye for composition. Some of the pics could benefit from some post processing in a graphics program like photoshop or paintshop pro. A few of the landscapes are heavy on the magenta or cyan scale, a few have washed out skies (there are techniques to deal with that). Best to post a pic in a thread for specific feedback or answers to questions you may have.

Me and my husband left US on AP, which is valid until nxt year. We both were working on valid H1's until we left. We dont want to go for stamping and will use AP on our arrival at the POE. We havent applied for EAD when we left. Is it Ok for us to apply for EAD once we are back in US or is it ok to apply for H1's again once we r back. In both cases whether we go for h1 or EAD, can we start wroking rt a way or do we need approval first.

My situation is tricky here. I would really appreciate any inputs.
My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:
Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.
Please guide me through the process and any scenarios. Thank you in advance.

Our lawyer had posted our application on July 2nd and we had our fingerprinting scheduled for 21st august which was completed.
I checked my status on the USCIS site for the very first time today. And it says. "On July 30, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case" . Can anyone kindly explain me what this means ( how July 30th and what mail are they talking about ?we never received any! ) ...

Hi,
Previously worked in a Supply integration company A, and EB3 job desc shows role as a consultant "responsible for ERP implementaiton with some programming experience".
In that role later, Lets say I've performed Network and Systems Administration ALSO.
So I have a mix of all skills at the end of 10 years in the company.
Now if I get an opportunity from a company B that needs experience in Network Administration and some pre-sales (internal to the company),
1. Will I qualify to do the job and be under "same or similar category" to be AC21 compliant.
2. Can Company B file an EB2 and use porting of date.

This would be a limited portability - AC21. Correct? I'm saying approved I-140 for all practical purposes should serve like a temp GC. Maybe this is far fetched!!!

You can use either the current edition of 06/05/2008 since that's the version on USCIS web site or use the older version until July 31, 2008. From August 1, 2008 you MUST use the 06/05/08 edition only. I am sure your doctor will have the older edition.

I am a resident physician on h1b visa which is expiring on 6-30-2010 . I am in process of applying for H1B extension for my fellowship. My wife is on H4 visa (expiring in 3-20-2013 since she got 5 yr multiple visa). Recently she visited Kuwait and on her re-entry she was given entry (on her I94) up to 3-15-2013 (up to 5 days prior to her visa expiration). Will she also need extension in this case along with my extension or can she stay in US till 2013 with out extension Thanks.

Dont worry..my EB2 at NSC took 11 months for approval.
Talk to your laywer frequently as they recive the approval notice without the website getting updated.
Mine online status still shows "case received and pending..." when i got the copy of approval notice from lawyer in Nov.

I assume you are planning on working in Canada using visitor visa. This is not legal and if you want to do it anyway, immigration authorities would question your intent of travel every monday to friday, when you have a valid H-1B work permit in USA. I don't think you will get by this.
My cousin had a similar experience he worked in Canada for two months on visitor visa, Immigration authorities were tough on him when he was on his way back to USA, asking him how come he had such a big vacation in a calendar year and also various other tough questions.
My advice is to apply for work permit in Canada through your existing companies branches in Canada and then work in Canada as you have suggested.
Please don't follow my advice blindly, contact your Attorney and look at all the legal ramifications and then decide about your future course of action.
