If you indicated in your I - 140 that you want to do CP, NVC watches for PDs and when someones PD is about to be current they sent out (packet 3) which is the application packet to start CP. They send this sometimes 6 months before your PD is current.
That is it, if you turn around the application packet soon they will start processing until they are done, and wait for visa number.
You can swich from AOS to CP, but I am not sure about the procedures. There is good information on Ron Gotcher's forum about the CP process.

Not only do you get SS but you also have to pay taxes to US irrespective of where you live for the rest of your life. So on a net it is still arguable depending on your long term residency plan. And my friend, Social Security is going away in the next 10 years. You think the USA can maintain this kind of a deficit for ever with people not willing to see an increase in taxes.

I couldn't agree more with you. This is the worst thing to happen for ppl who have been patiently waiting in BEC lines since 2001 !!! But remember you are getting screwed now others have either been screwed at some other point or will get screwed later. We all get screwed :D
I couldn't agree more. I am one of the lucky PERM filers with a 2006 PD who will get to file the 485 next month....but doesn't mean, I haven't been screwed before.
DOL screwed me the very first time in 2001 with my RIR labor....after 2 years they remanded it back to traditional labor...since 2003 it had been languishing in the labor queue and then at the BEC until finally in 2005, I lost my job...
After 4 years of struggle with the DOL, all I got was to start everything all over again in late 2005....In 2005 when I started this new job, the 485 filing looked almost 5 years away...through all of this me and wife had started living separately due to our professions and respective H1s...
Up until May of this year, it almost seemed like nothing was going to change and we will have to keep up with this wait and separation at least for the next 3 years or so...
But, we do get to see the light at the end of the tunnel now..

why would EB2 retrogress to before 2003? It was at 2003 for a long time (8 months?). The only people still with PD of EB2 2002 are the ones just getting out of BEC, there cant be too many of them...
Yes, I agree. For the same reason, there may not be much EB3 2001 and 2002 cases left. Hence Eb3 would move to 2003 soon.
BTW, my PD is not 2003 :-)

Thank you, Totoro for leading this effort. My suggestions are same as gc_dream07, but I would like to reword the suggestion
2) Remove the country cap for employment based immigration (the argument we should put forward is that when it comes to employment based immigration the deciding criteria should be individual�s skills now where the individual was born).
3) Capture the unused Visa (Green Cards)
Exactly, it is okay to have country cap for those who are coming in through lottery or for those who come in through family based GCs. But for employment based GCs, it should be the skill that matters, not from which country he comes from.

I may be wrong, but I had different impression. If officer felt that GC can be given in one year they issued 1 year EAD, other wise 2 years EAD. When I got 2 years EAD, I was not happy about it.
But several things go wrong and people might not have got GC despite getting 1 year EAD. I feel that people getting 1 year EAD must have every thing ready, just waiting for their Visa Number.

Actually, H.R. 5921: High Skilled Per Country Level Elimination Act is equally important. Why am I from India being discriminated against as compared to my neighbor from some other country if we are doing the same job for the same company. That way if everybody is in the same boat maybe there will be more uproar about 5882 because I'm sure other populations are more vocal than Indians and Chinese.

I know Congress passed earlier to recapture loast Visa's..can we urge USCIS to do an Admin fix of recapturing the Visa's based on precedence...why does the congress need to involved again?..

your lawyer is right. When you file 485, your employer should give a employment offer letter that states that you have a job offer as per the terms and conditions of labor certification. That includes the geographical location of the job offer.

I spoke with IO on 3rd, initiated SR on 4th, initiated congressional request today i.e. 5th. My Infopass is on 11th. Will complete 10 years in US on 13th. Birthday few days after that. So I guess something should work...ROFL...

The online application system gave me a date of Nov 27th. I go to consulate on the scheduled time to find that the office is closed. That's really bad. Luckily here in NYC, I went on the same day on Nov 27th and it was opened. The passport was sent to me by mail and received it in 10 days. I was surprised by the way the crowd was handled. I think it depends on the top person who is in-charge of the consulate.

I got the "card production ordered" email today which probably means that the gc application has been approved.

I got married last year and the lawyers were about to file the follow-to-join application for my wife in the next couple of days. But my application seems to have got approved first. Has anyone been in this situation before?

VSC - This actually may not be a very good situation for you. Now that your 485 has been approved and you are a permanent resident - your wife's application will fall under the Family 2A GC category which has a wait time of somewhere around 18 months or so. Again this is my understanding of the law...I do hope for you that you don't have to wait that long...

that is good news thanks !!! so the IO did talk to you even though 1 month has not yet passed ? I called yesterday and the systems were down ..but she said that if 1 month has passed and I have not recd the card then she will open a service request or something ..did the IO tell you that too ?
(I know this is a tracker only ..but I guess it is more helpful if we discuss posts like above too ..my advice to those on EAD's (and not H-1) ..file as early as possible ..This is a messy situation which can lead to bigger problems as drivers license cannot be renewed in many states without EAD !!)
I talked with customer service and they said that I have to call after 30 days. But I insisted asking "lets say i call after 30 days and I have not recieved my EAD and my current EAD is expiring and I cannot work after that. I asked for Evidence..I told her I received receipt notices , fingerprint notices in 5 days then how could you expect me to beleive that EAD is in mail for 25 days..I asked for options in this scenario which i know she could not answer and finally she transfered to Level 2 which is IO. he looked in some software or something I do not know but he said its not printed yet but in queue, both mine and my wife EAD's.

Well, here we are: the water is IV's target...the pebbles are the contributions ($200, great, but $20, still good!!) from a large number of members. It's impossible to justify why one can not contribute $200 when the core members and some others like you & anurakt have given so much more. I believe it is equally important to encourage as many members to contribute as much they can.
No contribution is too small if it is actually made. An ounce of action is better than a pound of intention!
The weekness in this analogy is the absence of a time limit on the crow. If the crow will die by a certain time, then the crow better start putting bigger pebbles.
It will take 10 months to pay $200 if you pay $20/month. Legislation may start coming up in Feb. Money is needed to get the issue on the table and NOT when the issue is on the table. That time is right now.

Called all of them..left few Voice messages also..one of them encouraged me to call my local district rep. first, which i already did..i also gave my contact deatils to couple of them..hope it is ok...they said they will send me a letter..dont know for what ?
