It is good to see the combined Immigration community efforts are bringing results. However, it appears that no attention is being paid to raise the issue of children ageing out because of visa retrogression and delay in labor clearance. The Child Status Protection Act(CSPA) passed in the year 2002 hardly provides any relief to I-140 based immigration petitions. While for I-130 (for US Citizens) applicants the date of child is frozen on the date of submission of I-130 form it-self, but for employment based immigrant applicants this Act provides a complicated way to calculate the child�s age and it just provides relief for any processing delays in 1-140 clearance only. It just ignores the fact that we have years of retrogression for employment-based category. At the time when this act was passed there was no retrogression in employment-based category and lawmakers perhaps never thought of hardship, which children and families may face because of the retrogression.
We need to raise our voice on this issue too. My son is going to miss out the chance of getting his green card just because his age works out as per formula given in CSPA Act to be 21 years and 12 days � because of 12 days my family may be penalized to be separated from our child whereas no one is going to consider 3 years delay in labor case in my case and then another 13 months we have to wait for filing 1485 after approval of I-140. Mine case was the most unfortunate in the sense that I got my I-140 approval in just 29 days whereas in all cases the normal time is 3-6 months. Had it taken 2 months, my son would have got the benefit under CSPA.
I hope some one from Immigration Voice leadership team will take a lead to highlight such issues also before the law makers.

it does contradict with what they said in April VB, but Ron said that his source is Oppenheimer. so I would go with what he said. remember, it was Oppenheimer who told him back in Feb or early Mar that India EB2 will have a cutoff date in April.

Yeah, but the 5th item being demanded is the same as a free trip to the moon with out any flight training. In a logical and sensible world it will not work and will make this forum and organization look like have no motive or direction with every demand being considered viable., just beacuse it "sounds like a great idea" to a few folks.

I mailed my passport about 3 weeks back to SFO. Have not yet got it. Anybody done it recently?
SFO is taking 3 weeks for in person renewal. I gave mine and got date of April 2 (which was 3 weeks away). Probably mail would take few extra days.

I don't know if there was a memo. I think AILA communicated this to the lawyers and I read it on Ron Gotcher's forum.
Apparently, the re-interpretation of laws were based on the changes in AC21, something they were ignoring till 2008.
Removal of country quota in EB catagories (if excess visa's available in any catagory, becuse of 7% impossition) was due to AC21 law. This was a result of hard effort by similar group like IV in 1998/99. DOS paid attention to this law only in 2007 (after 7 years). I think some lawyers/AILA brought this to DOS.

Finally I was greened after 4 years and 3 months from my I-140 approval date.
I opened a SR yesterday and today my CPO e-mail came to my mailbox. However my wife's status says
"On August 2, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later."
Do you know what does it mean?:confused:
I am not sure whether opening a SR helped or not. Good luck to everyone. Remember GC is something but not everything in life. Being healthy and spending quality time with your family are more important than GC.

For your PD and EB category, you are able to enjoy 4 years of AOS benefits just because of IV. You will soon get your GC, only because of IVs continuous fight with CIS.. But hey you won't see it because it all happens behind the scene and someone else is picking your tab...

The driver of the cab talked to me and said there was a man in a suit who forgot his blackberry in my car. H1B was not started to help people from all over world, It was started to help US corporates to fight talent crunch..
If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them .
