Can I apply for H4 along with H1B (my spouse)? If not, when is the earliest time I can apply for it and in average, how long will it take to change of status from F2 to H4?
Also, If I am currently under F1 visa, can I change of status to H4 while studying? Is there any requirement that I have to change of status from F1 to H4 before I complete my studying a number of specified days/months?
One more thing, I heard that if I have Canadian PR, I am allowed to work in the US, is that right? If so, how long can they work in the US?

What I meant is that he has REMOVED that advisory from the site. He has not printed an actual retraction.
I still see his old report there, including "The USCIS hands may be tied, should the EB visa numbers for FY 2007 is exhausted before the end of July."

my answer to Q 16 was C9 and the instructions said that for C9, send it to NSC for applicants living in CA. Hope this is correct!

On my wife's labor certificate, it is said her position requires a minimum of master degree. But the alternate is bachelor degree plus 2 years' experience. The lawyer has filed I-140 under EB2.
We are worried that this position does not qualify EB2 because we read on the internet that EB2 requires master degree or bachelor plus at least 5 years' progressive experience. We called the lawyer and said we heard from a friend such a case had been denied. She was very busy and just said there was no problem to apply for Eb2, and if we doubt it, we can hire our friend as a lawyer. We are so pissed off.
Can someone help me clarify if this position is qualified for EB2? do we need to change it to Eb3?

So Monkeyman, once a person comes to US, he/she should never complain, obey the orders and become subservient, and if treated like dirt, should still shut one's mouth. Looks like you are happy to be a slave to the system!!
Personally speaking, these INDIAN (yes thats with caps) body shops are the reason of H1B abuse. But what can USCIS do if there are crooks sitting in Hyd selling H1Bs for few lakhs.
And people have either become so naive or are really desparate that they fall into their traps as was evident by some lady on murthy forum who incessantly advocated that one needs to get H1B before looking for a job!!

As suggested by pappu/starsun, this supporting thread provides impacted members with additional information and tools to help the initiative.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

My attorney still feels that USCIS will have to accept the applciations.She is not promising me to file the day she gets my papers.I dont know what to so .At least yr lawyer understands that DOS can ask USCIS to stop apps..

Hi I received from Chinese friend whose has some connections with lobbiests. Nonetheless, that is only for Murray amendment, but not for the HR bills. So please don't stop calling just because of it.

The Murray Amendment is only on the Senate side which reportedly has been dropped from the Senate version of Appropriations Bill. What we are campaigning are for the separate stand-alone bills in the House which when passed will go to the Senate.
I am sure that our provision on the Senate side supposedly died because of the AgJobs which gave ammunition to the anti-immigrants to drop all immigration related measures from the Appropriations Bill. Some of us who have been thru this roller-coaster ride before, kinda saw this coming.
Again, please keep calling for the house side relief to our problems.
