    I paper filed EAD to AZ drop box on Mar 27th. I have not received receipt. Also check is not cashed.

    I agree, it is taking too much time, compared to previous applications.

    I am still waiting for check to be cashed or receipt.

    I think, I made a mistake of paper filing. I should have done e-filing.

    Agreed lets not bash illegals in public. My point is 'legal Path' for illegals has just become almost impossible with the current congress and senate configuration.
    Lets focus our efforts on piece meal instead that have provisions to fix employment visa backlog.

    I was wondering is this a firm news that- Labor gets expired after 6 months if you dont apply for 140..

    It it right.. am thinking it depends on state to state ?

    Yes, approved LC expires after 6 months. This rule has already been implemented by DOL along with labor substitution elimination.

    you are correct, those petitions from academia/non-profit are not counted against the cap, also they enjoy the benefit of being able to start working as soon as it get approved as against the other H1b where u have to wait till october if you are filing for the first time.

    Hi everyboby,

    I have question about the "deadline" to get non-profit job. Now I'm on OPT and looking for non-profit job. My OPT will expire on 1/14/2008.

    Do you know how long will I get the H1-B visa after I apply for it? If my OPT is expired but the H1-B visa has not come yet (but applied for it), am I still legal to work?

    My question is: if it take, for example, 3 months to issue the visa, and I still have not get a job on 10/14/2007, then I should give up and find a community college to get a F-1 visa, right? Am I correct? So, is there any "deadline" in my case?

    Please give me some advices....Thanks!

    The good thing is eliminating the country quota is always lumped with doubling the total quota and/or recapturing previous years waste, so hopefully the affect evens itself out.. Eliminating the coutry qouta by itself is a disaster.

    the elimination of country quotas alone only redistributes pain...where our goal is to end everyone's pain. we asked for all the measures on our agenda and we support the whole package together. we want a better immigration system for everyone.

    Its great that someone is actively looking into this, but will the whole 'security' issue backfire if USCIS decides it would rather waste the visa numbers than getting into this kind of mess in the future by processing everything swiftly?

    I agree, i am afried that this is going to back fire and would let USCIS waste visa numbers and we all can continue our wait ever after. Nice job

    my name was not interview with my family.
    my family gave interview and embassy asked for original I140 and I824 approval notices to check my eligibility.

    i submitted and now after 2 weaks got the follwing reply:

    In your case , the I-140 was filed on sept 10, 2001 and approved on october 08, 2003. The visa became available on october 08, 2003 . Form I-824 was not filed within one year of visa became available. <my name> was born on January 03, 1986. because he (me) is above 21 years old an immigrant visa as a derivative beneficiary of Employment third prefrence (e3) immigrant visa category cannot be inssued to <my name>. In order to qualify for a visa, he (me) would need to benifit from CSPA. Since form I-824 was not filed within one year of visa becoming available on October 08, 2003.
    <my name> cannot be processed under CSPA.

    SO plz help me with right advice and solution so that i can travel with my family.
    my mom and bro got te visa and it will expire in 6 monts and i want to go with them, can i be able to get visa in any case before their visa expire?

    i badly need help.

    This post should be in a very prominent place (like About Us etc.) on this website.

    The poster has not only made it abundantly clear about the reason for IV's existence but also made it plenty clear about what they have done and more importantly learnt in the past 5 years.

    I have been visiting this site on/off for the past couple years and didn't know half of it.





    We are spinning in circles here and it is like reinventing the wheel. This is THE grassroots org �THAT you want to set-up. already set up to achieve exactly that � YES, YES �We want Congress to introduce a bill to reduce backlogs. The core goal of IV is to have a bill that has our provisions. That is exactly what this organization was set up to achieve. You seem to be a newcomer to this struggle. Have you followed IV from 2005 Dec when a buch of members got together on some other forums and watched helplessly as good provisions (that were meant to allievate our troubles) were taken out at the last minute from a bill during debate.
    Since then we have tried and tried and frankly have matured enough to understand that the politics of the immigration issue is complex and any standalone bill �just for us- has no chance.

    Our provisions have to be clubbed with all the rest of the minor and major groups � that want reform. There is the nurses lobby, the doctors, the illegal lobby, the dream activists, and many other fringe groups, they all want their issues to be addressed. The anti-immigrants are a big opposition to any small relief that comes up in debate. NOW- We have learnt that we need to work with all these groups, form alliances and lobby hard to get a bill that has more support.

    If you go meet with your lawmakers you will understand that our issue is a miniscule little piece of a bigger issue of Immigration. And different varying and sometimes opposing groups have to be accommodated. The politics of immigration is convulted with different factions of the society wanting different things � Our little issue is straightforward and we enjoy a lot more support for our provisions, unfortunately we were clearly told that we have to be clubbed with these other groups when it comes to seeking a bill for reform. We are being held hostage also by the Hispanic lobbyists, that feel that if smaller bills come up and are passed, there will be no apetite for their bigger issue of legalizing a big core of mostly Hispanic illegal immigrants.

    FOR A RECAP- after this administration came into office �Jan 09- We had hopes and were promised that CIR (Comprehensive Immigration Reform) will be taken up, if that fails then smaller bills will be allowed to be taken up. If you have watched the developments carefully �There was never a time and a lot of groups including IV lobbied and lobbied hard to be heard and to get a bill but- the legislative calendar with so much other priorities had no space for any immigration bill this year. After the healthcare bill, Nobody has had any energy for a big controversial bill.

    Long story-short is YES, we want a bill (either clubbed with others) or amendments inserted into a bill- But have not been able to get it done.

    The reason for this failure is us- IV Members. We have not met our lawmakers in the numbers that are important to make an impact. We have to do it every month- building pressure to get a positive sympathetic response. Now some members (including yours truly) have gone and met our respective lawmakers more than 6-8 times in the last year, but that is again not enough, that is just 20-25 odd members compared to total IV Strength of 40,000members. It has to be an ongoing effort, just like the dream activisits have done, they meet with lawmakers regularly, highlight their frustrations and are open to media �giving interviews and keeping their issue alive in the limelight.

    IV has come up with specific recommendations for what we would like to see in a bill/s for our community. IV actively analyses any bill that comes up or has a chance to come up for debate. If you want to get your hands on that document, contact Anu or Pappu and ask for the IV_Advocacy package.

    We do have a paid lobbying firm that represent our interests and educates lawmakers. This is not enough, because during debates lawmakers behave as if they do not have highly skilled immigrants in their constituency and so do not have to pay attention. This is mainly IV members fault, since we have not been able to visit lawmakers offices in the numbers that we should. Our members need to show up at lawmakers offices and educate them. Tell them you live in their constituency and represent IV so that when the lobbying firm does their work, they are paying attention and our voices are not ignored or drowned.

    Individual members need to be open, honest, and courageous enough to talk to their lawmakers and media about issues we face. Just crying and debating on IV's website does not help. Talk about introducing a bill for us to your lawmakers � not here on IV.

    Folks,

    Please call the below selected members from CHC. There are reasons why we should NOT be calling every one in the CHC. The members we have to target from CHC and their corresponding numbers are listed below.

    Tell them that you would like to talk to some one who handles immigration/legal matters, If forwarded to voice mail, leave a VM. If the VM is full, you can get back to the main line by pressing 0 and then leave a message with them.

    The message you have to deliver when calling these offices is

    I would like Representative "Representative Name" to co sponsor bills HR 5882 and HR 5921, sponsored by Zoe Lofgren. Both of these bills have wide bipartisan support in the house and will help reduce the back logs associated with USCIS. These bills are a great first step towards immigration reform.

    DO NOT GET INTO THE LEGAL/ILLEGAL DISCUSSION WITH STAFF MEMBERS

    Only if the staff member bring up the issue of CIR, in that case say that -

    In the past we have been supporting Comprehensive approach and still continue to support comprehensive approach and we look for our our main issues to be addressed whenever comprehensive bill is passed. However, this is is just an interim fix to begin or start the immigration reform process.

    Has anyone started fundraising yet??. I did not. I need to work on recruiting 6 more people atleast into Team IV. We should have 50 people for the Cal. Event atleast. I need to work on the networking events as well

    I have started my fundraising, but that is only because I have all the fundraising ideas in my head.

    I will start sending out the Welcome Packages this week. The Welcome Package has a section for Fundraising and will help each Team IV Member reach his/her goal.

    The first T Shirt order has also been placed, last week, I believe. I should be receiving this initial order by mail shortly and then I can mail out the T Shirts to those who have signed up thus far.

    We need to still concentrate on our recruitment efforts this week and the next.

    The Dolphin South End Runners Club has welcomed us for their Aug 17, 2008 event. I am hopeful that we can get a contingent of at least 20-30 Team IVians to walk run that event.

    Hi Everyone

    Finally i got the email saying card production ordered on May 10th. My priority date is Ju26th 2006 , EB2. Thank You IV , Aman , Anu, Himanshu, Gopal and all other IVans for the help and most importently Aman for forming IV and giving us a forum to congregate and fight for our cause.

    I am donor member since 1.5 yrs, was a member of advocacy day event last year. This april i could not take part because of a family emergency back home. IV has helped me immencely both informationwise and also psychologically during days of regression.

    I will continue to be DONOR member in the future as well. I hope that will help other IVans.

    With this attitude and arrogance, I rarely think there would be motivation for anyone to do anything for IV.

    I started discussion by asking , how can IV convince me that my donation is going to help, I got shot down by ARROGANT ******** and got all reds as if I care. I was planning on a charity/donation drive of my own to get some money for IV.
    Know lot of consultants, who really dont know what to do with their miles with every one a executive airline status.
    Already have 10+ people pledging Poker tournament from my poker group with their miles for Airlines and hotels. We are talking of a Million AA miles.
    Indian restaurants(s) having a Immigration week where a dollar of each bill be given to IV.
    I was even thinking of standing at Indian stores in Dallas to ask people to consider for IV cause, as long as I believed and hence was asking.

    I was just getting started with so many ideas for my free time.

    Good luck in what ever you do guys. Note that GC is not everything and note that I am still on extended H1, family on H1 and EAD never helped me. so assumption that EAD helped my life is baseless. All these hypocrites are long gone from IV once they get GC. All we get is response that Mr X or Y , even after getting GC, is working fro cause. How can I believe.

    Any organization can be successful if there are questions answered and not shot down. Just working at DC doesnt make some one a strong contributor for IV.Work at grass root level is so imp. What I have noticed is any one who went to DC has become headstrong, egoist and arrogant as if they own IV.

    Your argument doesn�t make sense at all. All are lame excuses at best. If you want to see what people are doing, you need to start work with people, see and believe. We cannot give you the notarized copy of certificate. You cannot sit on the fence and ask people to convince. As I said earlier no one is getting paid for what we are doing and no one is doing any favor for others either.

    Dont waste everyone's time with your useless arguments. If you really want to do something, start the campaign for whatever you believe and if its really worth people will follow you.

    Years we have been told priority date establishes your place in the queue.

    We have spurned job offers and declined the new PERM process to hold on to the priority dates.

    Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.

    People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.

    Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

    Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

    My advice to you is to beg, borrow, steal or kill but find a way to file for the I485. The benefits of filing for AOS - specially if you have a spouse who cannot work - far outweigh any short term struggle you may have to endure.

    I am debating if calling them on April 1st to ask for my status will help them pick me? But then there might be so many people calling....??!!
