It is pretty obvious they will surely receive more than 40K petitions. Who knows, they must have already got the same in June when they advanced the dates in June VB. Visa numbers are allocated at the time of approval and not at the time the petition is made. Even if they get million petition in July, that does not mean all the Visa numbers are consumed. It is an indicator they have enough petitons to meet the demand to use all the available numbers and alter the VB Cutoff dates for PD in future months. It depends on the approvals too and it is not likely the petitions made in June/july will get approved now... So we must be okay.. but you never know with USCIS/DOL/DOS... Any thing can happen... for instance like the VB is Current for all categories in July.
That's what we all are thinking, that we should be okay. But when rumors like these are posted on reputed attorney's website, it will surely create panic among people.

The visa number has become current for my PD and i will be filling my I485 application even though my I140 application is in process ( Attorney says i can do that :)).
I was looking at the I485 form and it has a question: List your present or past membership with every organizations, associations, funds etc.
I am resigtered with my Alumni organization besides volunteering for few not-for-profit organizations. Has anyone of you listed the organizations even though you were jsut a volunteer?

Slumdog...I totally agree with your view point and in fact share the same. I believe you cannot put your life on hold waiting for GC or something unpredictable. I also agree with you that buying a house is a life style decision. You can live ur life hoarding cash living cheaply or you can live your life well. Also each has its advantages and its a personal choice.

Your wife should be good to stay with your change of employer upto the date mentioned in her current I-94.
I have been in your stage. I changed my employer last year. I asked same question to my attorney from my wife. Attorney said that there is no need to apply for another H4 because of mine change of the employer.
We went this year to india there was no issue to get the new visa stamped on our passport.
Note: I am not an attorney and sharing my experience with you. Please take a legal advice from attorney.

I am on H1 with 485 pending. Now that I can file for my wife's EAD, If she starts working on EAD do I need to also give up my H1 and start working on EAD?

My wife is eligible for fling for AOS right now , however she has already accepted a position with different salary and designation with the same employer and asked the employer to file a new H1 b, I dont believe its been filed yet. We never thought the dates would be current in our life time
We are thinking of refusiong the promotion offer, however the boss is willing to helo keep the new job waiting for her and continue her green card processing in the current designation
1. I know you can change jobs after 6 months of I-485 filing.at that point can she use the EAD to work at this new job or she can only port the EAD to a similar occupation?
2. Other scenario is then have to a future job offer for the category that she has applied to green card through either from the same employer or a different one.. and asking for a H-1 B for the job with a higher salary?
3. If the spouse derivative uses the EAD can the primary applicant stay on H-1 b Status without using her EAD or is it going to be considered as though she used her EAD and hence no longer in H-1B?

Like it or not In legal language you become more so called bright in EB2. If you apply in EB1 you upgrade your so called brightness. It does not matter in reality who you are. But as far as law goes for EB1, EB2 and EB3 etc it prioritizes based on qualifications needed for performing the job function. Our employers and lawyers decide on those requirements. Have you questioned those requirements?
Maybe if we had questioned those requirements laid down by employer and lawyers, more people would be in EB2.
Yes you are absolutely right, had we questioned, then some of the brighter and brightest wouldn't have been legally brighter and brightest (would have had to experience downgrade of their brightness). Most of the brighter and brightest wouldn't have even got into the path / line to become brighter and brightest. Since you are in legally brighter side I am afraid that you won't be able to comprehend the issue and solution of less legally brighter ones.

I would suggest IV to setup a seperate Chinese (or Hispanic) contribution page to diverse the culture background of IV members.

I talked to a staff member at senator Barbara's office, and the staff member said, Faxes and emails are responded and replied by staff reps. Only written (typed) letters go to Senator's attention. She also advised me that if this is something you need the senators attention on, do not send fax or email, send a letter with postage paid.
I explained to her the visa -flip flop, and she said most likely the senator will read and send an inquiry, The senator is very good at responding to letters from constituents.
That is exactly why we need to send them letters, please look at the format and add some personal details, gives it a little personal touch.
I agree. My experience thus far: I emailed 200 reporters and received no response. I am going to try the letters idea, because I too think what Amitjoey says is right-- letters make an impact.
Write a letter, run a grammar/spell check, then print, SIGN, and send it to senators who support us. I wrote the following. But please personalize, because that would send the message that this is an issue of importance to you-- the writer.

In response, USCIS announced that it would return all Adjustment of Status applications it received, beginning July 2, 2007. Please note that the USCIS had already RECEIVED applications on the morning of July 2, 2007, even before DOS published this interim visa bulletin.
In my opinion it is an unfortunate decision in that it virtually renders null and void, thousands of properly filed Employment Based Green Card- Adjustment of Status applications.
An important thing to note here, is that in the Visa Bulletin published by DOS only 18 days ago (June 13, 2007) all Employment Based categories had been made �current� since almost 60000 immigrant visa numbers had been unused till that time.
This begs the question: how did USCIS manage to approve about 60000 green cards in less than 3 weeks, when it took the previous 8 months to approve the same number of green cards?
The Visa Bulletin published by DOS in June 2007, had brought good news to thousands of high-skilled temporary workers (doctors, engineers, IT professionals) in the USA, because the floodgates that had been closed for over 2 years had been re-opened.
This bulletin had implied that we could finally apply for "Adjustment of Status"- the final stage of the 3 step Employment based Green card process. This would solve a number of quality of life issues for people like me, as they would allow our spouses to take up part or full time jobs, they would bring in an element of stability allowing me to plan the purchase of a new home, and it would give me the freedom of relocating to another part of the USA for any unforeseen reason, without worrying about the portability of my existing job.
Therefore, my family and I worked really hard, and tried to religiously comply with all procedures laid out and submitted our application to reach the USCIS on the morning of July 2, 2007.
Besides running around to gather the paperwork to help file in time, I had to spend a significant amount of money on:
1) Urgent medical examinations and vaccinations by USCIS approved surgeon: $700. (Note: These were not covered by my medical insurance.)
2) New passport photographs; these needed to be less than a month old... so these had to be newly taken photographs
3) Notarization/ Courier charges: Approximately $100 (Some amount expended in foreign currency)
All of the money spent, as well as the time and efforts were rendered useless by the new bulletin on July 2, 2007, which I repeat, was published AFTER the window opened for new applications on the morning of July 2, 2007.
My point is, and I believe anyone with common sense would agree, it is only fair to expect a notice period before a reversal such as this one. Preferably... weeks of notice if not days! I am sure no US Citizen would accept anything less for a notice in such an important matter!
I would implore you to look into this matter as soon as you can, and request the USCIS to accept Adjustment of Status applications filed through July 2007.
