imh1b and snathan....i respectfuly request that you'll refrain from calling anyone names....there is no need to call people fool/drunk/moron. I am quite sure youll are educated professionals that can think of better ways to make your argument.
Wait a minute. I did not say that the person is a fool. I said the "idea" was foolish and gave reasons for why it is unworkable. The guy wanted to debate, so I provided my input and views. What's wrong with that?

Since the DREAM Act has already got a lot of traction, it might be easier to try to attach the issue of aged-out children with it, rather than trying for something new like amendment to CSPA. A simple amendment will solve the problem for most aged-out children: remove the following words from Sec. 4(a)(1)
"who is inadmissible or deportable from the United States"
That will make the Act apply to all children, not just undocumented. I am sure most congressmen will readily agree, it might actually help change some no votes. It makes no sense to cover only undocumented children and keep other children out.
My information:
1. Your Contact Information: (Send me a PM)
2. State Where You Live: Claifornia
3. Your Employment-Based Category (EB2)
4. Your Country of Origin (India)
5. Your Child's Date of Birth: 06-25-1983
6. Your Case Priority Date: 08-30-2002
7. Date Visa was available: 07-01-2007
8. Date DOL approved your Labor Certification: 06-14-2007
9. Date I-140 was sent: 06-29-2007
10. Date I-140 was approved: 07-23-2007
11. Anything Else You may Want to Add: (The original labor was EB3. We filed another labor onder PERM EB2 in May 2007 that has been approved. Currently trying to port the earlier PD to EB2 case)

It looks like EAD-AP single document is still being delayed.....
http://www.immigration-law.com/
06/27/2008: USCIS Update From Vancouver: Single EAD-AP Document Plan
This plan is still in place but the USCIS is pushed ahead EAD related programs step-by-step. The USCIS has already launched two-year valid EAD. However, unlike EAD, in the reform of Advance Parole program, the USCBP is also involved since they will have to perform inspection function for the admission of the aliens. Accordingly, the USCIS has been working closely with the USCBP to work out the final plan. Once such coordination is completed, the USCIS intends to launch the single EAD document that can also be used as an Advance Parole travel document. It may take a little bit of time, but it is also a good news that the USCIS will launch this program in the future.

Well it's obvious that it all boils down to what you bring to the table.
But that is with any company, it you're not providing revenue to the company you will get fired.
But at least IBM is not hiring H1B's without having a project in which to put people. I doubt IBM makes people like on their resume, I mean not minor lies, blantant lies like making a Fresh grad show 5 years of experience.
Several Indian consulting firms offered me this.
Did you ever hear name called Enron , Anderson consulting and Computer Associates ? Try to do a google search on Enron and Anderson consulting :D

Arun,
As far as EB-1, 2 & 3 is concerned, these categories are created so that some people, as seen on this forum, could just stroke their egos thinking that they are better than others around them. In essence, this is another form of discrimination so that people like you and others could fight on forum like these ;-).
By your logic, why even require a degree for an H-1B visa? Why not allow janitors, waiters, domestic help, etc. to apply for H-1B visas?
You are missing the most critical part. The H-1B visa is a "skilled worker" program. Why should the U.S. not be able to differentiate and prioritize based on level of skill? The level of skill may be hard to measure, but accredited degrees are certainly the quickest and most objective way of doing so.

yeah but thats not the kind of training NIIT would provide you (Assembly level stuff, parallel programming concepts etc). Such training institutes teach you programming, what mundada was talking about is software engineering.
I stand corrected. I misunderstood his statement. I thought he was referring to a non-US degree. Yes, I agree, a sound theoretical foundation goes a long way.

I have submitted all the documents to my laywer on 6/25 itself (including medical) but they are just heavily back logged and won't be filing my case till Jul 10. I am just frustated now. I even offered to pay extra to speed it up but no use. I am only worried if dates retrogress half way through?
To my real question.. Can we just file on our own with out the lawyer? I would hate to loose this window just coz my laywer couldn't do it. Not sure how I would break that kinda news to my wife, "I know the dates were current for 10 days in July but our lawyer didn't have time so now you will have to stay at home for 1 more year".

My labor certification (Traditional EB-3) is stuck in BEC since last 5 years. It is completely beyond my understanding why it took so long for BEC to process my case. Now everyone is rejoicing USCIS's decision to accept all green card applications, but I am paralyzed with the fear of facing another huge backlog on I-485 applications. One government agency sits on our applications for years and another government agency throws us further back in the line to cover up its blunders and guess what who pays the price: WE RULE-ABIDING, LINE-WAITING FOLKS.
Even if I get my labor approval before September, I will be among the last persons to get labor certification in spite of being the one with the earliest priority date. Nothing would give me greater pleasure than suing DOL BEC at this time. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on their web site that they have tried to maintain FIFO, it makes me feel like puking.
I am also disappointed with IV's attitude towards the backlog victims. I do not remember anything concrete done by IV to address the grievances of backlog victims. Now that they have won the battle with USCIS, will they have time to look at us?

did your company receive the 45 day letter that they sent for all BEC cases.
did they give the letter to you , it might have been possible that either they did'nt receive the letter completely or they might be with-holding information from you
what does your case status say
you must have seen that i am waiting since the last 10 years, since their processing is so random that there's nothing that you can do . The worst thing that you can do is feel bitter about others who are getting benefited.
you have to fell happy for others that they are able to get out of the un-desirable situation that all of us are in.

From uscis.gov:
Change of Filing Location for Form I-765, Application for Employment Authorization
WASHINGTON - U.S. Citizenship and Immigration Services (USCIS) today announced revised filing instructions and addresses for applicants filing an Application for Employment Authorization (Form I-765). The change of filing location is part of an overall effort to transition the intake of some benefit forms from Service Centers to USCIS Lockbox facilities. Centralizing form and fee intake allows USCIS to provide the public more efficient and effective initial processing of applications and fees.
Beginning February 24, 2010 applicants must now submit Form I-765 to one of the USCIS Lockbox facilities or the USCIS Vermont Service Center, based on the classification under which they are filing. Detailed guidance can be found in updated Form I-765 instructions as well as at USCIS Home Page (http://www.uscis.gov).
The Service Centers will forward incorrectly filed applications to the USCIS Phoenix and Dallas Lockbox facilities for the first 30 days, until March 26, 2010. After March 26, 2010, applications incorrectly filed at USCIS Service Centers will be returned to the applicant, with a note to send the application to the correct location.
When filing Form I-765 at one of the USCIS Lockbox facilities, you may elect to receive an email and/or text message notifying you that your application has been accepted. You must complete an E-Notification of Application/Petition Acceptance (Form G-1145), and attach it to the first page of your application.
Form I-765 may be electronically filed (e-filed) with USCIS when submitted under certain categories. View our Web site for a list of who is eligible to e-file Form I-765.
For more information on USCIS programs, visit USCIS Home Page (http://www.uscis.gov) or call the National Customer Service Center at 1-800-375-5283.
