    I may be completely wrong but this is what I see on thomas.loc.gov


    Appended to the Minimum wage bill was SA187 which amends SA112 sponsored by John Kerry and consponsored by Sununu, Snowe, Landrieu and Lieberman.

    Senate Amendment SA 187 seems to have passed with unanimous consent. This is what it apparently contains among a lot of other stuff... Please correct me if I am wrong.

    SEC. 1601. ELIMINATION OF EXISTING BACKLOGS.

    (b) Employment-Based Immigrants.--Section 201(d) of the Immigration and Nationality Act (8 U.S.C. 1151(d)) is amended to read as follows:

    ``(d) Worldwide Level of Employment-Based Immigrants.--The worldwide level of employment-based immigrants under this subsection for a fiscal year is equal to the sum of--

    ``(1) 290,000;

    ``(2) the difference between the maximum number of visas authorized to be issued under this subsection during the previous fiscal year and the number of visas issued during the previous fiscal year; and

    ``(3) the difference between--

    ``(A) the maximum number of visas authorized to be issued under this subsection during fiscal years 2001 through 2005 and the number of visa numbers issued under this subsection during those years; and

    ``(B) the number of visas described in subparagraph (A) that were issued after fiscal year 2005.''.

    SEC. 1602. COUNTRY LIMITS.

    Section 202(a) of the Immigration and Nationality Act (8 U.S.C. 1152(a)) is amended--

    (1) in paragraph (2)--

    (A) by striking ``, (4), and (5)'' and inserting ``and (4)''; and

    (B) by striking ``7 percent (in the case of a single foreign state) or 2 percent'' and inserting ``10 percent (in the case of a single foreign state) or 5 percent''; and

    (2) by striking paragraph (5).

    (b) Preference Allocation for Employment-Based Immigrants.--Section 203(b) of the Immigration and Nationality Act (8 U.S.C. 1153(b)) is amended--

    (5) by redesignating paragraph (5) as paragraph (4);

    One small correction,it is DOS instead of DOL.

    DOS or DOL, the logic they apply for setting the dates in the VB is LOL.

    I thought i was the oldest, but someone got a GC this week after 16 yrs wait. my first attempt was in 1998 sept (never filed and sat in the lawyers office for 6 months) while i was working hard. Second went into NY DOL (2001) and after 4 yrs my company shut down - labor was in backlog center. Last attempt started in 2005. Aug 11th it will be 15 yrs. Not sure what i am doing here or why i am clinging on to this. Hanging in the same field, no growth and no enthu. Most of my friends put up their citizenship oath taking pics in facebook or are back in india

    we waited so long, hang in there for a few more days. hope all will be fine.

    I may beat you on total wait time. it's 15 yrs since i entered this country (1995).
    first labor filed 1999 (11 yrs back), current one started in 2004

    so, you are saying dates in eb2 moved because, few of the eb2 folks showed up in DC. I think its time for you to up your medication...

I hope the IV Admins / moderators are reading and take necessary action. He / She is just enjoying at our expense just by creating confusion.

    My GC was approved today... I came to the US 10 years back. It's been such a long journey that it's tiring to even think about it. The backlog processing center, re-starting the GC process, Several H1b visa stamps, July fiasco rollercoster... At this point I think I am just tired - not happy, not sad...

    There is an advantage to filing through CP when USCIS is slow to process applications. According to statistics this has been the case for last 10 years with USCIS.

    CP approvals are pretty fast and when you apply they do not wait till the dates to become current, NVC process the application to the point where the only thing it needs is a visa number.

    For example April 1st when an applicants PD is current NVC will request a visa number for the applicant and any derivative applicants around the 10th of April (this is stadard practice). Then typically in the next 60 days (May or June in this case) schedule the interview. You get the visa after successful interview.


    We completed package 3 already last August and sent the forms together with ORIGINAL certificates to the NVC as requested. They also asked for the visa fees at that time which we also paid. So I guess we already have visa numbers ?
    Our sponsor company in the US is waiting since almost 3 years for my husband to start working for him. I think we're lucky that he's willing to wait so long and didn't give up at some point during this whole process ?

    Update: I received my renewed PP from CGI Houston. Here are the details

    CGI Houston received : 18-Jun-2008
    PP issue date : 27-Jun-2008
    Fedex date :02-Jul-2008

    Fedex attempted to deliver it on July 3rd but I was out of town till yesterday. I picked it up today (9th July). CGI-H took about 10 business days to process. I decided on purpose to send my application after June 15th, so that all the summer travelers would have renewed it by then. I dont know if that helped me, but I am happy I got new PP in 2 weeks.

    CIR bill is only supported by a few US citizenry groups. Even those Hispanics who are here legally do not support it. Let's face it. If it weren't for the provisions helping EB based PR applicants, even IV wouldn't support it. Given all this, I highly doubt if Dems will gain if CIR passes. I certainly can feel the general US public against CIR. And I live in Portland, Or, supposedly one of the best liberal states in USA. Best case scenario for this bill could be a pass, at the end of the year after elections provided all it's supporters get elected.

    Remember even Mr. Bush said he wanted a immi. bill by the end of the year (wink wink)

    We had our fun while driving - we had a new IV member, Naveen's friend a doctor who just came from India a month back and trying for residency. His name is Arun.

    Now Mr Arun missed Indian food as he does not get it where he lives and was kinda home sick. We stopped over in the Edison area and packed some junk food.

    He meant that 140k Visa numbers allocated each year, out of which less number Visas are actually processed by CIS, all the unused visa numbers in the past which might be more than 300k should be used now to reduce the backlog.

    CIS did not issue all those 140K visas for past sevaral years despite of the fact that there were more than 140K applications pending with them during all those years. Those visa numbers were lost and the applications accumulated over the period of time due to inefficient USCIS process.

    This is what ombudsman said about this issue and I quote

    "For example, when employment-based visas are not used during the year they are authorized, they are lost and are not available for future use without special legislation. In FY 06, over 10,000 employment-based visas were lost, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards.36 Based on USCIS use of visa numbers as of May 2007, at present consumption rates approximately 40,000 visas will be lost in FY 07 without a dramatic increase in USCIS requests of visa numbers.37 As illustrated below, since 1994 there have been over 218,000 un-recaptured employment-based visas lost due to underutilization of the employment-based visas. " end quote.

    Hello friends,
    My birth certificate has the following information
    date of birth, Mothers name, fathers name, place of birth. It does not have my name and i am from India. Is it ok.. or should i get one with name.

    My PD is not current but i am getting ready with all the documents, just in case it gets current.

    I am in the same situation. My attorney advised me to have one with my name if possible. I scanned mine and my wife's Birth certificate and sent it to my Dad in India. He said that he will get the original in 2 days. Looks like it is a straight forward process. You could just send it with a copy of ur passport.

    P.S: They would need the copies to be notarized before taking it to corporation or municipality

    Wow! Lots of advices and opinions. Meanwhile the housing slump is expected to continue well into 2010. I remember many people on this board challenging me last year 'how do you know it will go down', despite me posting the supporting data and the trend. It has gone down and will keep going down until it becomes cheap/affordable. Maybe 2000 price levels?

    Yes, that is what the trend look like. There is probably another 5-10% fall in the works. Perhaps even more. I agree with you on that.

    However, the million dollar question is how do you know the prices have actually bottomed one? Won't you go ahead and buy if its affordable, instead of wasting precious years which shorten the career span and deferring your decision? Its almost like deciding when to have your first child...well..almost. There is never really a good time, is there?

    By affordable, I mean its around 'x' times your (dual) income, you have your green card and you are prepared to live in the US for next 5 years at least (even if there is any family emergency, you don't have any compulsion to sell off your assets and move to India for good). Now, 'x' may mean different for different people but generally people seem to agree x = 3. And I also agree with you that it might happen that american housing is always affordable. Yes, it might but for most middle class in SFO Bay area, when x was 7-10, it wasn't affordable at all!

    I completely oppose folks like Slumdog doing something terribly rash (no gc, no prospect of gc within a year, single income with a baby, baby having some health issues and to top it all the burden of a heavy mortgage on the shoulders, god, I think his situation is simply awful...) but the way I read it is that these indeterminate immigration waits are making people throw caution to the winds.

    And I don't agree with folks who feel that buying your house is like renting it out simply because it is mortgaged. There is big difference, eventually its get all paid off and you start actually owning it. Secondly, for a lot of people that they can sell it during their retirement and use the sale proceeds to cover the retirement life. There is very good chance real estate would have appreciated over long term. Of course, you are just interested in 'flipping' you are asking for big trouble.

    Couple of questions to all gurus:

    Is there any time limit to say birth certificate is recent? I got my birth certificate in Jan'07, trying to see if i need to sumit the affidavits?

    Also do we need to have copies of all I-94 cards since the first time we entered US? Looks like i don't have the I-94 copy which was issued when i entered in 1999 for the first time. In that case what would be the solution?

    I am not an expert, but as far as I understood it's not the question when the birth certificate is issued, it's when your birth is registered. If the registration date in the birth certificate is a recent date then you need to submit the affidavit.

    You need the most recent I-94 card. All the previous cards are not necessary

    - You can add immigrationvoice.org link and a short message to any email with jokes, cartoons etc you forward. Talk about this serious stuff and then say, ... now some humor. This will ensure that the message of Immigrationvoice goes far and wide.

    - Make lot of photocopies of IV flyers from the http://immigrationvoice.org/index.php?option=com_content&task=view&id=22&Itemid=36
    volunteer section and keep in your car. Whenever you go to a mall, railway station, store or temple etc and see any South Asian, Asian, etc nationality people (since such nationalities are mostly affected by retrogresssion) hand over a copy each to them. Tell them breifly about IV. This technique has worked very well in spreading the message.

    I agree with Randy. I think Ron Gotcher mentioned something very similar. what I am not sure about is:
    Can one apply for CP after I-485 been pending with USCIS?? is that possible?? does than mean that EAD and AP will be automatically not valid to be used?? do we have to be current in the VB to apply for CP??

    If you filed AOS, USCIS is supposed to pull your case and start working on it when PD become current. From what we hear they do not do this properly, they do not follow establised guildlines (FIFO). CP has a distinct advantage in this regard. Only thing is you do not get to have EAD/AP.
