If he marry a US citizen, she can file his I-130 eventhough he is out of status.
(If the entry into USA is legal and out of status later, can adjust, if filed by spouse)
For parent , brother/sister filing, I don't know and I don't think it is possible.

My brother got a B1/B2 multi-entry visa for 2 years. My mother is a green card holder and my brother didn't want her to submit an I-130 on his behalf since she became a US resident. The reason was because one of the questions that the embassy asks when you apply to get a visa to enter the US is weather a relative submitted an I-130 on your behalf or not. If yes then the embassy thinks of you as you want to enter the US and remain there until ur I-130 is approved and a visa number is available.. my question is since my borther got his visa, will it be ok for my mother to submit an I-130 on his behalf now without having the embassy rejecting him B1/B2 visa in the future(that is after his current B1/B2 visa expire in 2 years ????
Another question if a person is in the US and out of status, can a relative submit an I-130 on his behalf and if yes how good is his chance to adjust his status when the I-130 is approved in the future??

Anyway, on Thursday I got a Nikon 24-85mm f/3.5-4.5 AF-S zoom and Tamron 90mm f/2.8 macro from KEH, as well as a Hoya polarizer in 67mm from B&H for the zoom (really wanted an IR filter, but the polarizer would be more useful most of the time). I also got an Epson R200, but that's a story for another time. Since the best part of digital photography is sharing pictures, I thought I'd do just that... :D

I think these bills are too complicated and have possibilities of failing on the house floor, even if they pass through the senate..
My question to the group is: Does it make sense for us to lobby for changes to existing laws as 'amendments/enhancements' (do not know the exact term), which need not go through this full-blown congressional approval process.. Another issue that we are facing with the bills such as immig. comprehensive bill is that we get tagged together with illegal immig., so it becomes all the more probable to get rejected. I am just being realistic and urging the IV team to add one more action item to the agenda and see if we can put some efforts towards this additional agenda.
I think, in addition to supporting the bills, we should look at this additional possibility. Something like allowing I-485 even though the number is not available, just requires an amendment to the existing law. It does not require additional quota, so there is no major impact to immigration law as a whole. So, we may not need to wait for a bill to clear, in order for such reliefs to be approved.
My take is: we should strive for 3-pronged approach - 1) near short term approach is to ask for immediate relief such as I-485 filing without the visa number availability; there may be other such reliefs possible - 2) short term approach is to support the current bills being considerd, as we are doing already - 3) long term approach is to think of what is the backup plan in case 1 and 2 fails

EAD does not confer any status to live in the US. Your status continues to be AOS. When the EB2 I140 is approved, the lawyer will either interfile it with the pending I485, or the USCIS will auto-approve your case if the EB2 priority date is current.

If we were able to get the 3 year visa rather than 1 year extensions, then the main problem that the BEC give us in a practical sense is that if we change jobs we loss our priority dates.
So while the slow processing is an administration issue, the law could allow for priority dates to be kept something like this:
"If a labor application has been pending for longer than [some time] then as of [some date], the applicant immigrant is able to keep the priority date of the original labor application whether or not the application is later withdrawn or disapproved."
This in combination with 3 year extensions would give people freedom to either refile for PERM with same employer or move jobs and file for PERM with a new employer.

Another solution would be to allow DoL to accept a large fee for premium processing. Making the fee large would have the effect of not too many using it and thus not overwhelming DoL, but it also might generate sufficient income to apply more resources to the remaining outstanding applications, and benefiting all while being practical.

My visa is H4 and I got my EAD last month, but my family's I-140 and I-485 on pending, if I use my EAD , unfortunately I-140 we can not pass, is that means I must leave U.S.A. in ten days?

I plan to use AC21 and apply G28. Any reasonable lawyer recommendation in and around bay area would be of immense help to me.
I tried Payal Singh and she is charging $1200 for AC21 and G28.
I checked with Arjun Verma and the cost is $400 for the same.

My Permanent residency is being processed thru Employer A (I-140 not done yet).
Employer A also holds my H1B. This is my only H1B, and it extends based on approved labor as I am on my 7th year if H1B.
If A files for Chapter 11, will my H1B and permanent residency get cancelled/revoked?
If my current H1B is valid till Nov 2010, and employer A files for chapter 11 in Dec 2010, will I be able to stay/work in US at least till Nov 2010?
What will be my options if H1B / GC gets cancelled? Can I transfer this H1B to a different employer? Or, can a different employer has to file for a new H1B? :confused:

GC/H1 sponsoring employer filing Ch11 has no implications on your current H1 or pending GC until the company starts liquidating (files Ch7). I have been in the same situation and I just recently used AC21 and changed employers by transferring my H1 to my new employer. Original company has been in Ch11 since Jan'09. My 8-11 yrs H1 extension (based on approved I-140) with my original company was pending when they filed Ch11 and USCIS had no issues approving it in Mar. As long as your current position is not eliminated (laid off), there is no problem. It will definitely be an issue if the company announces Ch7 liquidation before you can transfer to a new employer. Once the company is in Ch7 and USCIS figures it out, then it could revoke your H1 or send a NOID on your I-485. Hope this helps.

Not much happening in this shot. Seems like it needs a bike leaning against the wall, a bench, a red pot, something to give a focal point. Either that or a shaft of sunlight down the street. I'm bothered by the leaning wall on the right. Makes me feel like it's going to fall down on me. Two potential shots I see in the scene are the door and grillwork next to it, if you can get the right light on them, and the hanging plant. Tough to shoot narrow streets like this when there's strong sunlight above but the streets are all in shadow. Did you try other angles/perspectives when shooting this? If so, they might be worth looking at.
Played with the image a bit in Photoshop to see what I could get out of it. Not sure I did much but I'm no expert, particularly with curves. Maybe someone else can do better. A black-and-white version also might be good.

Is this NEW employer or same employer .
If NEW employer ,then u can apply for new H1B petition but cannot ask for extension of stay .
Extension of stay is for someone who is already in USA on H1B status .

My AOS was filed June 29 th and I am waiting for the recipt notice.
Now, as the AOS is filed, will it make a difference later on - filing AOS under EB2 would have got him the Green Card ealier?
