Is there a way to receive an official answer from USCIS (may be IV can ask the question, not sure)? Or is there a law that specifically bars people to leave GC sponsoring employers? I was unable to find from the Internet. Can anyone find?

I applied on May18 for I-140 and will be applying to I485 soon.. and would get EAD...so what happens to EAD and AP...I cant beleive they are
waste..Probabaly people with pending I-140 will be subject to the new systems..??..what do you guys think??..Its not pratical to drive people down the Queue again..

I am still waiting for FP notice, i got my EAD/AP/RD, for both of us.
It was filed @ NSC on July 6th, ---> CSC -----> NSC. I got my LUd on 09/21 last on our 485.

Too many issues at that time. Old h1 was anyway expiring soon. Desi bodyshoper employer was going nuts sqeezing me dry. He was demanding money for everything from H1 extension to giving out compnay letters for GC related issues and thousands of such reasons. But as I already said.. it's done..it's done...
Your employer should pay for H1 and H1 extension. If he is exploiting you, and you accept being exploited, then you should also share the blame for accepting this.
This forum has past posts where people have shared information on how to complain against such employers. One of the goals of IV is to generate awareness in employees so that employees can use their voice against injustice.
Accepting such 'exploitation' should not be tolerated and you must take action against such an employer. It is such employers that give a bad name to the entire H1B visa program and the whole community is blamed and made to suffer. Our bills face an uphill task because of this. Employees must complain so that they can help fix the H1B and green card system.
I hope you use your voice and take action against such employer. IV is against such exploitation and it must be reported to DOL and USCIS. If you have to go to court for it, you should consider it.

OK guys, here is what I think. Being in US on a visitor visa, and then applying for an I-485 does seem like a violation of visa terms, but the other way round seem to be fine. I mean she can apply for an I-485 first in India, and then apply for a visitor visa later while her I-485 application is pending. While applying for a visitor visa she just has to honestly tell the consulate officer that her I-485 is pending and there should be no problems.
If she applies for I-485, she has *beyond a shadow of doubt" expressed immigration intent. Her visitor visa request will immediately be rejected.
If this is not so, then it means that all those who have filed I-485 in their home countries through consular processing route are in effect barred from entering US till some decision is taken on their application. This sounds bizarre. Does not make sense. What do you say?

We are not sure of the chronology of events such as your wife's pregnancy, Your job change, your insurance start date. If you guys had individual insurance before your wife's conceiving, insurance cannot deny coverage as pre existing condition. Make sure you put these events in a time line and rule out the possibility of coverage. if you have done so, you have to explore other options.
As far as changing job is concerned, make sure your job requirement matches the same and similar concept. If you have used AC21, why not use it one more time? Only one question: Ultimately for which companies the h1b consultants work for? It is not for Indian companies. It is always for projects in US companies. Mind it. Let US companies decide whom they want? I do not understand Why some people here are talking that Indian companies are using h1b etc etc.
Go and ask US Govt to provide free College education in computers to everyone in US. Then you will not have all these problems right. Instead of dealing the problem that way simply blaming trade laws?

These companies outsource because it furthers their bottom line and enables them to do what they are good at may be it is home loans , making cars or selling clothes. In the process of outsourcing they can hire best talent with in their means to complete the job in a limited amout of time.

2 H1bs , like, If one is on bench but getting paid by that company, starts working with 2nd company on transferred H1b, so it is like double pay for about 2-3 weeks .
If you're getting paid while you're on bench with Company A, and Company B has transfered your H1, and is paying you as well, that's not a problem. The problem arises if you're on bench and are not getting paid. On H1, one has to be paid even if he/she is on bench.

- I have my H1 until Sep'09.
- If i change the employer will i get an extension for 3yrs based on the approved 140?
- Do i need to file 140 again with the new employer?
