hey guys...
I read this amazing thread and I am feeling terrible guilty of not going to DC for Rally. I thought contributing $100 was enough.
YES, I GOTTA GO TO RALLY AND BE A PART OF THIS EFFORT. AND I WILL GO.
Guys: If IV wins and we are able to change the law.....and then someone comes across you and ask:
"Did You help?"
What will be your reaction? Will you pump your chest out and scream "YESSSS..."?

We have been living in a county which has implemented 287g for some time. And I believe all legal residents in my county feel safer because of its implementation. Sure, there is a chance that 287g can be misused by the police. But tell me one law which can not be misused by police.
The thing is that more counties are signing on to 287g. St. Mary's County Joins Controversial Federal Immigration Initiative - Southern Maryland Headline News (http://somd.com/news/headlines/2010/11667.shtml).
I went thru the proposal in Arizona and could not find even one point which might be bad for us. Did any of you find something? http://www.azleg.gov/FormatDocument.asp?inDoc=/legtext/49leg/2r/summary/h.sb1070_04-13-10_houseengrossed.doc.htm. I feel, IV should support such laws. We want the citizens and law abiding people in this country to support us; not the illegals.

I also have a PD in the same year as yours (May 2004), but my I-140 is still pending. God alone knows when it will be cleared. But I try not to think about it.
Instead, imagine as if you already have your GC. If you suddenly get it one day, think about what your next steps are going to be. If you want to join a new company, think and plan about ways you will be able to market yourself. Plan for the future. You have plenty of time now to do research and analysis, because as soon as th GC comes, you will need to put your plan into action. Everything happens for the best. Assuming your whole life is ahead of you, what is a 4-5 year wait. This too shall pass.
I have observed that on an average an EB2 ought to get their GC in 5-6 years from when they applied for labor, whereas for EB3 it is around 6-7 years. Now folks may get it sooner and it depends on individual case, but my observation tells me the above. So plan accordingly.
Don't let anyone take your happiness from you. Only you determine how you feel and you can choose to be all depressed about it or not not worry about it and focus on something else. It is just a state of mind.
Perhaps a couple of years after you get your GC, you will look back and think how resilient you have become because of this long wait. If nothing you have gained a virtue - patience.

Ask your law firm why they are charging you so much. Below are the rates charged by my lawyer and should not be too different from what most of the others charge. If the lawyer doesn't answer, then show these numbers to your employer and lodge a strong protest with them.

If you are working on an hourly basis, does your employer pay you when you're on the bench? If he doesn't, keep record of that and once you get your GC sue him over back wages and complain to DOL. These people don't deserve any thing better.

Yes you are right, there is bound to have EAD flood in market, with spouses of hi-tech worker will come to market to search hi-tech job with spouse phone support. I have seen such cases countless times in past few years and yes they will be in future without exception. However, matter of fact, these fresh EAD (previous H4) don't get the dream job in first attempt, it takes good 2 year to find a similar job that H1b hitech worker does.
But thats the realty of market, every year new jobs are added and every year new job seekers join the crowd.
On the otherside, a hitech worker is suppose to always learning something new and getting his/her position more stronger everyday, its a knowledge market, whoever knows more gets better $$. With my 7yr US exp and total 10 yrs CS exp I have no scare that any single fresh EAD will come close to me. A senior is always a senior no matter which field you talk.

As per the data, so far people with notice date (on 485, from NSC) before sept 1st have got their FP notices (except few people). So, I presume if someone's case transfered back to NSC from CSC before spet 1 st, he or she should expect their FP notice soon.
Obviously, we are not going get our notices if there several people lined up with NSC notice dates before our transfer dates.
This is just my logical conclusion, may be incorrect

Strangely, everything is done within the scope of law!

I called USCIS customer service regarding the DOB mistake in the AP application.
Here is what they suggested � No need to file another AP or revoke the current application as USCIS already has my correct DOB data based on past applications and they will note the mistake and can match it with the correct one because it is the second time I am applying for AP.
So while sending my documents, I am simply going to add a letter pointing the error in my DOB.

I may have to respectfully disagree with this.. Mine was approved on June 13th 2006 and my PD is current.. I have seen many EB2 with a later PD and 140 approval being approved.

Congrats suresh..it's good to see Dec 05 getting approved..best option would be to get your wife here on F1..Some of the schools required only TOEFL ..after coming to US get married again in US and apply for 485..
485 derivative status is only available if you were married before the 485 approval not after
If someone marries after 485 approval then you need to file I130 under family category for spouse
Of course it is always possible to come on h1 and get a new new gc application filed thru employer - but it is not possible to add as derivative application with a lawful permanent resident

1. PD EB3 SEP 2003 for which my I140 was approved and I have applied 485 during July 2007.
2. PD EB3 MAR 2002 I got my I140 approval yesterday.
All for same company.
Is it possible for me use my new I140 for my 485 which I have I filled already? I have requested my company’s attorney to find options.
