It all depends on what country you are a citizen of. If you are a passport holder of a country like Canada,Autralia or most european countries, then you may not see much benefit in holding a US passport when travelling. But people from certain other countries, have to go through the hassle of obtaining visas prior to international travel, vacations etc. Sometimes we even have to get transit visas for countries that we pass through on our way to the final destinations. And these visas cost money. But if you hold a US passport/citizen of the US, then they do not make you jump through all those hoops. You board the plane and you get a visitors visa once you land in almost all countries (there are exceptions, India and Australia for example). But there it is. That is one of the priviledges of having a US passport.

It looks like you are aware of some USCIS internal policy that is not known to all. I used to think that the policy was based on the per country quota for each category. Maybe you can enlighten us all. What is the acceptable gap in PDs between EB2 and EB3 for AOS approvals? In your example it seems to be less than 4 years. Can someone with a PD of 2005 (EB2) get approved before another person with a PD of 2001 (EB3). Since you seem to understand the policy so well, could you please explain it in detail with specifics?
First of all you did not have to bring EB1 in the discussion. I do not understand where did you feel challenged so have to come up with biting tone. FIFO is category base... You are bringing nothing new. Kid waiting in India for his first flight to USA know that. You have to have a eye to see the big picture. If you analyze the whole design and take the perspective country based... You will find that retrogression policy in addition to FIFO's ultimate effect is - for an example-EB2-India: 2006 PD would not be able to get his GC before EB3-2002. But somebody must not be mentally challenged to derive that. It is not long wait. From next bulletin you will start seeing pattern.

I am in the same boat. I wish you are true. Its so frustrating to see 2006 folks getting approved (I am happy for them that at least they are getting approved but it is unfair that we are still waiting) and we are still waiting. Ridiculous....

Did you apply for your 485? Your profile does not show that it has.
The date on which your 485 is filed is the order on which the applications are processed.
your PD is only used to say whether an application is eligible for processing. Once it is eligible, it is the 485 application date that states your position in the queue.

my company lawyer responded to my similar question saying they too fear the mid month retrogression, and will try to file ASAP. However, the explanation offered in other posts in this thread (notably, logiclife and shantak) does sound compelling. as someone said, file asap if you can. if you cannot, do not worry, as 1. it won't help and in 2. my humble opinion, shutting the door for ALL within the first month of opening the door for ALL, will be a shame, and will set a very bad precedent, so most likely they will wait at least until end of July before the shut the doors.

From my experience with trying to convince EB applicants to join and contribute to IV, I get the impression that most of them suffer from a 'subsidy mentality' - they hope others' efforts and money will subsidise their GCs, just like their home countries subsidised their education. Sorry, that mentality just wont carry us too far in America, the temple of capitalism. It is up to us to solve our own problems - no one will feel sorry and wave the magic wand for us.
They don't even have a towel , they are just sitting on the benches and watching !! Many don't have the guts to fight.

You really cannot do anything in a short time except hoping for the best. Two things have to happen for getting a GC (i) Your file should be or should already have been reviewed, and if all good to go, preadjudicated. That depends on your receive date by the Center processing your case (not RD on your receipt). This date is close to ND, and is often seen online as " your case was received on...". If this date is prior to published dates, your file definitely has been reviewed. Farther it is from the published date, lesser the chance, but approvals are indicating that if it is Aug, Sep, Oct 07 there is very good chance, though September has higher chance than October (ii) Your PD should be high enough. As per USCIS SOP preadjudicated files are piled in sequence of PD's.
Note that both conditions should be met before leftover visas exhuast. Third condition, which always plays significant role is, luck. This means, you hope that IO working on your case did not fall sick when he/she was about to look at your case, some document did not slip out of your file, person working on your case head proper eye glasses so as not to misread your PD as 2007, stack of preadjudicated cases did not fall down losing file sorting sequence, etc. etc.

I am renewing my passport at Houston and sending it via mail. I was on F-1 originally and changed to H1-B last year. I do not have a H1-B stamp yet. What visa document or visa photocopies should I attach? Do they have to be notarized?
I have only have the new I-94 showing my H1-B status.

Have you tried to reach the CIS via infopass? 'Aging out of children' is one of the extraordinary situations which can force the hands of CIS. It is on the USCIS guidelines. In your case, you can ALSO go to your congress members to look into this. Extraordinary situations require extraordinary responses. Good luck.

I don�t buy the argument that only India and China produce the brightest people who are willing to work here in U.S. There are just as many people from Europe and the rest of the world who are just as qualified and who would want to work in the U.S. The problem starts with the H1-B visas, where most of them are taken by these Indian IT consulting companies. Correct me if I�m wrong, but I don�t think these IT companies hire non-Indian workers. There are many qualified people from the rest of the world who are willing to work here in U.S, but can�t because the majority of the H1-B visas is going to Indians and Chinese nationals. I think, apart from running and walking 10 miles I am able to involve myself doing other expected activities. In my life time I have not walked 10 miles:)..Man, you guys are tough.

i met a guy like this last weekend. came to US 2/3 yrs back. has masters in India and has 5 yrs total experience. not doing any research. He is actually a contractor at a client. the employer, applied his GC under EB1. he got GC under 1yr. I was amazed.
he says, his employer applied for few of his other colleagues too, but rejected. most amazingly, for one of his boss (1 or 2 levels above him) also they applied under EB1 but his app was rejected. unbelievable stuff. i guess the EB1 verification is random.
EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.
This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1. :mad:

How long does it take for a decision under EB2? I know the usual is 90 days but from your experiances is there a chance of an approval earlier?
