    I am very surprised about the requests for cheap photos !!! What a pity.
    We were ready to spend thousands of dollars just a month ago just to have the ability to apply for I485, but when you get a chance , try to save a few dollars and risk an RFE , delay in processing or even denial.

    Walmart photos suck , so are CVS photos. I had them take my pictures in the past. Never used the walmart ones and CVS photos got rejected for visa revalidation. They used Polaroid camera at walmat and they were not good at all.

    I took them at Macy's studio , costed me about $30 for 6 copies but they are great. Please choose a professional studio, $20 extra dollars are worth every penny.

    Some one mentioned about saving $20 and have a dinner. I would rather have peace of mind knowing my pictures are good enough for USCIS than have a $20 dinner.

    Just my 2 cents though. May be I am extra cautious because I got burned once :)

    "It seems that the bill S 1085 (the Reuniting Families Act (RFA) has become active again. I received e-mails from Senator Menedez and Senator Lautenberg talking about the bill. Senator Menendex mentioned the recapture employment-based visas that haven't been used in past years so that they may be used in future years. Among other things, he also mentioned that he will continue to address the concerns of employment-based visas in the context of comprehensive immigration reform. He is the sponsor of the S 1085 bill.

    Senetor Lautenberg mentioned "Under current immigration law, employment-based immigration is limited to 140,000 visas, or green cards, per year. The process for obtaining employment-based visas can take years to complete, causing many of these visas to go unused. There is also an annual per-country limit that caps at seven percent the number of employment-based immigrants that can come from any one country. In some instances, this per-country cap causes employers to consider country of origin, not talent, when hiring foreign workers.

    A bill has been introduced in the Senate that would address some of these delays and caps. The �Reuniting American Families Act� (S. 1085) would recapture unused employment-based visas from prior years. This bill would allow the Department of Homeland Security to issue any unused visas from Fiscal Years 1992-2007 and in the future roll over any unused visas from one year to the next. It would also increase the per-country cap for employment-based visas to ten percent of the annual total."

    It seems that Senator Menendez is doing a lot of work to bring relief to all immigrants including employment based. It may be brought in the lame-duck session in December.

    lets stop this rhetoric on repubs, what about bobby jindal, marco rubio & nick haley and plz don't give explanations to distort the reality, many in the republicans sincerely support legal immigration, tell me few good things dems did to legal immigrants, aint regan the one who gave amnesty to illegals in 80s, aint bush the one who tried more than once to pass CIR, who opposed h1b fee increase recently?

    Great. Thanks. That's what I had thought until someone came out and said that digital photos are unacceptable.

    Check the photo guidelines from USCIS website here is blurb

    The first thing I would do is call the IRS and ask them for advice. You may call the IRS at 1-800-829-1040. Have the employer name and federal ID ready when you make the call.

    You can also file Form 4852 with the IRS which is a Substitute for Form W-2. Please check http://www.irs.gov/pub/irs-pdf/f4852.pdf

    IRS is usually very helpful. Call them up, they will help you.

    No IV provision is in the bill.

    For something to happen, each member needs to do their part by supporting this effort and taking part in action items. With so little support and initiative we cannot expect to match the kind of hard work DREAM act advocates have done.

    If we need an amendment, we should be showing up for advocacy day or signing up for monthly contributions, volunteer our time, or doing any state chapter work by meeting local lawmaker offices regularly in groups. Dream Act folks have built a very strong network and advocacy effort that no politician can ignore. Go through the list of things they have been doing over the past few years and you can judge how much percentage we have as a community matched that effort. This is a reality and and ultimately it will be us that are responsible for no bill being passed in the last few years.

    The community needs to do more than wasting time on the forums and trackers if they really want any bill to happen.

    I agree that a lot needs to be done and our current efforts are definitely not at par with DREAM activists however i believe that some one from the community should take the initiative and i am pretty sure people will follw (atleast members can try to encourage effected people). Lot of folks are expressing interest in volunteer activities etc on the forum and i think we should utilize the enthusiasm..immigration is definitely one of the hot topics now and i think we should use thsi oppertunity to raise our concerns and make sure that some thing gets done for all legal immigrants. I like the idea that we need to have local state chapters/regional chapters to start meeting law makers however we need to make sure that these communities are active. When i joined IV forum, i was looking for an NJ chapter but the communities i saw are inactive for quite some time.

    if they've less calls, they can do some other real work.

    in any case..they took 1-3 months in case of reciepting 65K H1s. How soon do you think they can receipt 10 times that number..


    That was before their newly found 'effeciency'...

    more recently, they took 2 days (not even working days) to APPROVE 25000 AOS applications, how hard do you think it is for them to issue receipts ? :)

    Changing to vertical spillover will NOT help EB3 India or China. EB3 ROW is not current and it will suck up all overflow leaving EB2I, EB2C, EB3I and EB3C to their annual quota only. USCIS changing the process to horizontal spillover is the best thing that has happened to I and C community in the absence of immigration reform. Now there is at least some hope for EB3 folks to get a new job and apply in EB2, as at least that queue is faster. If we fight among ourselves and stop vertical spillover, it will only benefit EB3ROW as they will get all overflow from EB1 and EB2ROW. Please guys, let's not fight.

    If there is a fire in the house regardless of how you arrange furniture at least some of it will get burnt.
    So stop giving advice like these and focus on extinguishing the fire.

    I still don't get it. There are around 300k AOS applications now pending. Given that there are only 10k EB based green cards for India, and I am sure there are more applications than 10k for FY2008 and still Visa bulletin for Oct indicates a date of Apr 2004. Should it not be "U" for the entire FY2008?

    5. This employer is a consulting company...(desi) & they asked me to sign a financial agreement to repay their expenses on labor substitution/I-140/I-485...if I will leave them early. ...Is it legal to ask for such kind of agreement...?

    Please let me know as much as info/ guidance you can provide to me.

    Asking you to sign an agreement is not illegal. There are employers (even big names) who ask their employees to take care of the expenses for GC processing. The main concern should be to verify if this company practices fraud. The only way to check is either by searching on the web or talking to some other employees who work for this consultant (making sure these employees are also not part of the fraud).
    I am sure you have heard about people like Nick Mandalapa who were filing multiple I-140 for the same labor certification . The sad part is that there is no USCIS online system to verify if a labor certification was used to successfullly file I-140/485.
    And remember that if there is fraud it can haunt you ater in your life even "AFTER" you get your GC. USCIS can revoke your GC at any time if there is a proof that a fraud has occured in the process.

    You may admire them as much as you want but fact is these are just "glorified" bodyshoppers. I meet many workers from these "great" companies at my workplace and see them being treated just as "low cost alternatives" and nothing else by this huge financial company in NY/NJ area. Because of their (INFY, TATA, Wipro, Satyam) "low billing rates" these guys cant afford good lifestyle. And back home in India INFY and TATA CEOs make billions and talk BIG. I've not met any TATA, Satyam guy here who is happy with their employer. They just hate their employers and always looking for a change. I wonder where they stand in terms of employee satisfaction? They treat their people like slave and send them as low cost labor. Not only that - they exploit US immigration rules and make use of L1 to keep their people long term at cliant place when they dont get enough H1.

    No difference from local bodyshoppers! Dont think they are great companies. You may say "you folks are frustrated with these companies". But this is the fact. Period.

    I think this thread is hijacked. I will also join the band :p I work for one of these companies (SWITCH - Satyam, Wipro, Infosys, Tata, Cognizant, HCL) and came on L1, became H1B and on the path of GC through the same company. Some of what you have said is correct that the employers are not paid same as what IBM US employers get (and of course what some consultants get). Some of the issues are working off-late hours and coordination effort etc.

    The positive side of these companies is
    1) Career advancement - One can really grow into lead and managerial positions if they have the aptitude
    2) Technical Career Paths are there for those who are technically inclined.
    3) Benefits - There are good benefits which usually may not be there for those working for desi-consultants
    4) Support from a large pool of knowledge - If I face any issue, I post it in my company help forum, there will be many responses,some real good ones within a day.
    5) More job security - companies are not yet used to down-sizing. In hard times, there could be some salary rationalization (which I think is OK - better than losing job) and increased utilization (again doesn't mean more work from individual it means optimal bench strength)
    6) Growth - While it is debatable whether it can sustain the rupee strengthening or not, unless the company 's strategy is very narrow, nobody outsource for the cost alone...Many are simply build-or-buy decisions, and based on core-competency and risk management. Deals that are struck these days are multi-year, multi-million dollar ones which will provide guaranteed business over a long periods.

    Coming to those who come on L1 or H1, most of them want to get an opportunity to work at client location to better their perspective (apart from Dollar conversion). Nobody comes here by force. Their priorities are always different than most of the forum readers' Their choices are also limited. Some leave as soon as they come here (I personally interviewed at least 10 folks last year who floated their resumes as soon as they landed here), some want to go back after working here few years, some switch to H1Bs through desi-consultants, thus enter rat race, some try to grow here in their company on long term basis.

    Hope this clarifies few who pity SWITCH employees..

    Again these are not "glorified" bodyshoppers. It is a very wrong impression. I am a manager at one of such companies. We have highest regards for our personnel, we strive hard to make a big difference, we compete with other service companies like Accenture, IBM and EDS, have high client focus and we feel proud about it. Never in ANY meetings or strategies we keep our employers' interest below anything.

    Thanks so much man! Actually I was all set for Sept 13 but have a work appointment on Sept 18, yet I am even thinking of cancelling that to attend. I don't care how expensive it is.     Look at it this way -- An additional quota means more regular EB visa's to go around which will help all. Asking to give 20k more GC's for US Graduates will sound more easy on the ears than asking for a general 20k increase.

    This is the worst bill ever. 1987 amnesty bill atleast had a flawless game plan when it was passed. This one will not pass. If it passes, I am going back to India. At least in India polititions are not brainless, they are only corrupt. I choose to go back to India if this bill passes. And if dubya signs this bill, he will be the Tuglaq (most foolish Indian emperor ever) of USA.

    This thread is interesting... US is headed to a economic slowdown currently (everyone knows that), and Bernanke (the fed chairman) and others are working hard trying to guide this country to a "soft landing". Some foriegn banks/investment firms have already withdrawn US market from their investment lists/porfolios, and this will get worse for this country. Japan went through a major slowdown in the 90s and it took them more than a decade to recover. As funny as this post can be, but US will have to look at every angel to stablize their economy, even in a small scale. This does not isolated to housing only. Issing green cards to highly skilled immigrants can only better this country, not worse. After all we put greencard into good use and I believe most will agree on this.
